ADOPTED: ORDINANCE AMENDING CHAPTER 7 OF THE CODE OF THE TOWNSHIP OF ROBBINSVILLE ENTITLED “TRAFFIC”, ADDING SECTION 7-25.1 ENTITLED “LIMITING USE OF PUBLIC STREETS TO CERTAIN CLASSES OF VEHICLES”

CONSIDERATION/APPROVAL OF THIS ORDINANCE
WHEREAS, N.J.S.A. 40:67-16.6 affirms the authority of a municipality to limit the use of streets to certain classes of vehicles pursuant to N.J.S.A. 39:4-197; and
WHEREAS, N.J.S.A. 39:4-197 states that a municipality may, by ordinance, limit the use of streets to certain class[es] of vehicles, except that such limitation must be approved by the commissioner of transportation if such limitation applies to commercial motor vehicles; and
WHEREAS, the Township desires to adopt an ordinance to limit the use of certain public streets based upon vehicle classification as established by the New Jersey Department of Transportation;
NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Robbinsville, County of Mercer, State of New Jersey that Chapter 7 of the Code of the Township of Robbinsville is hereby amended by adding Section 7.25.1 as follows [added portions are underlined, deleted portions are strikethroughs]:
SECTION 1.
§ 7-25.1. Limiting use of public streets to certain classes of vehicles.
A. Vehicles classified as Class 1, 2, 3, 4, and 5 by the New Jersey Department of Transportation shall be permitted on all public streets located within the Township.
B. Vehicles classified as Class 6, 7, 8, 9, 10, 11, 12, and 13 by the New Jersey Department of Transportation are hereby only permitted on the public streets or parts of public streets described below, except for the pickup and delivery of materials on all other public streets located within the Township, or the need to directly access a property accessible only from another public street within the Township. For the purposes of accessing a property accessible only from another public street within the Township, the public streets described below shall be used primarily and use of such other public street shall be for the shortest distance possible to access the destination property.

SECTION 2.
Pursuant to N.J.S.A. 39:4-8, a certified copy of this ordinance shall be transmitted to the Commissioner of the New Jersey Department of Transportation for their consideration and approval within thirty (30) days of the adoption hereof, together with: a copy of the Township engineer’s certification, a statement of the reasons for the engineer’s decision, detailed information as to the location of streets, intersections, and signs affected by the ordinance, and traffic count, crash, and speed sampling data, when appropriate.
SECTION 3.
All ordinances or parts of ordinances inconsistent with or in conflict with this ordinance are hereby repealed to the extent of such inconsistency.
SECTION 4.
If any section, paragraph, subdivision, clause or provision of this Ordinance shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision so adjudged and the remainder of the Ordinance shall remain valid and effective.
SECTION 5.
This ordinance shall take effect upon final passage, publication according to law, and approval by the Commissioner of the New Jersey Department of Transportation.
